The Executor is an investigative documentary about a growing American form of trafficking in which the elderly are victimized as cash cows within a criminal sub-economy worth billions of dollars.
The film exposes systematic exploitation of the elderly by corrupt lawyers, judges, and other professionals. Using loopholes in a U.S. guardianship system that functions in contradiction of its purported aim of protecting the infirm, these professional operate under cover of lawful authority to siphon off the life savings of masses of incapacitated ‘marks’ targeted by a network of conspirators posing as legal and medical protectors.
The National Association to Stop Guardianship Abuse (NASGA) calls it “a feeding trough for unethical lawyers and other ‘fiduciaries’ appointed by the courts to protect, but many of whom become nothing more than predators.” As far back as two decades ago the net into which countless elderly tumble was identified as “a dangerously burdened and troubled system that regularly puts elderly lives in the hands of others… then fails to guard against abuse, theft and neglect,” (Associated Press, Bayles and McCartney, 1987).
It’s all about the money… and it’s getting worse. This film draws on Stopelderabuse.org, the NASGA, and other groups to corroborate copiously documented cases of extortion, theft and fraud. It tracks criminal neglect, confinement of the unwilling as inmates in locked nursing homes, and outright murders.
The Executor personalizes the issue by tracking Matteo, an eccentric 73-year-old idealist who stands up for his parents through court actions alleging their torture and eventual physical elimination by a court appointed executor who liquidates much of their multimillion-dollar estate before Matteo can assemble enough evidence to act. Matteo has launched a David and Goliath battle against a legal system that destroyed his parents and stole his money. With unfettered access to our subject’s plight, hidden video footage depicting his parents’ aggressors, and the accounts of other victims, the film will reveal a shockingly corrupt justice system. It is a tale that would hail from the bowels of fascist regime yet it’s happening here, in America.
My background in social justice, advocacy, and investigative filmmaking (as well as being a victim of fraud) gives me a passion for uncovering the stories of the marginalized and for standing up to bullies. With the skill to deliver a non-biased journalistic piece through a cinematic journey, this film is an important tool in creating awareness for policy change against guardianship abuse. This is a story of how the marginalized can stand up to even the most imposing of bullies. This film will offer a unique first look at the hidden inner workings of a state-sponsored system that serves to ensnare unsuspecting victims into an inescapable web of fraud, theft, and abuse usually ending in death. This issue will only grow with time as demographics make the elderly increasingly inviting targets for the “perfect” crime of fleecing the most fragile and defenseless members of our society.
There is a great flaw in our society when a small community of ruthless people can target and destroy our elders without repercussion. As we reach a tipping point in aging demographics, this cautionary tale is extremely relevant. By exploring the myth of morality, the film intends to answer: How do you mount a battle against people with no rules or ethics?
The story I am telling weaves a deeply expressive tapestry of how hopeless it quickly becomes for anyone possessing the unique mix of audacity and naiveté to think they might be able to beat the all-powerful system of con artists, coerced accomplices and institutionalized judicial insurers that promises even those caught red-handed that they can buy their way out of jail.
The Executor exposes an epidemic of elder abuse and associated wholesale thefts of estates as the closest thing to the “perfect crime”. Matteo’s case is only the tip of the iceberg. The documentary will survey NGOs fighting such crimes, revealing how pervasive such crimes have become and how difficult they are to prosecute when relying only on testimony of victims whose first word of testimony risks being expunged as the senile grumblings of a legal non-person. As the final minutes of their lives tick away, countless elders suffer indescribable abuse and deprivations by perpetrators whose thirst for loot erases everything from a sense of family, to the moral concept of medical professionalism
Now is the time to make this film because Mateo is entering the legal system again and we will have unfettered access to his plight. This personal account will be held against the stories of other victims who have suffered similar discriminations. The result will be an account of gross injustice and the exposure of criminal and corrupt behavior in a flawed justice system.
By making a film that documents the struggle of those victims of this conspiracy, we are exposing the vulnerabilities of the elderly within the guardianship system. Through this process, we create awareness and generate discussion, so that policy change can take place, so that the exploitation of the elderly can be brought to an end, and lobby groups can be strengthened. The Executor draws back the curtain on a hidden nationwide epidemic whose worst outbreak is in the empire citadel of the rich, New York City.
